General Terms and Conditions

These general provisions (hereinafter referred to as “General Conditions”) regulate and govern the use of all services offered on this website (hereinafter “the Website”) provided by Francisco López Payá and Ramón Jesús Suárez Pérez (hereinafter “PaintForge”) for Internet users. By using the Website, users express their unconditional acceptance of these conditions, which may be modified by the owner at any time. In addition, users are subject to specific conditions, notices, or regulations of instructions that are informed to them regarding specific contents or services, provided they are in line with the General Conditions and do not oppose the same provisions.

1. USER INFORMATION

PaintForge, in charge of handling the processing of User information and personal data, informs you that such information will be processed in accordance with the current regulations on personal data protection, Regulation (EU) 2016/679 of April 27, 2016 (GDPR) regarding the protection of individuals concerning the processing of personal data and the free movement of such data. The following information about the processing is provided:

Purpose of processing: to establish and maintain a business relationship with the User. The planned operations for processing include:

  • Sending commercial advertising communications via email, SMS, or other electronic or physical means, current or future, facilitating commercial communications. These communications will be carried out by PaintForge and will be related to its products and services, or those of its partners or providers with whom it has agreed on promotions. In this context, third parties will never have access to personal data.
  • Conducting statistical studies.
  • Handling orders or requests made by the User through various available contact forms.
  • Sending the website newsletter.

Data retention criteria: They will be kept as long as there is a mutual interest in maintaining the purpose of processing, and when it is no longer necessary for that purpose, they will be deleted using appropriate security measures to ensure the pseudonymization of the data or its total destruction.

All data requested through the website is mandatory, as it is necessary to provide optimal service to the participant. If not all data is provided, it is not guaranteed that the information and services offered or provided will be completely suitable for their needs.

PaintForge may also collect information about the IP addresses of visitors, service providers, and approximate location. This information is analyzed and cross-referenced to prevent the exploitation of possible vulnerabilities through targeted attacks, malware, or bots.

In accordance with the current regulations on personal data protection, PaintForge is complying with all provisions of the General Data Protection Regulation (GDPR) for the processing of personal data under its responsibility and explicitly follows the principles outlined in Article 5 of the GDPR. These principles establish that data is processed lawfully, fairly, and transparently with respect to the data subject, and is adequate, relevant, and limited to what is necessary in relation to the purposes for which it is processed.

PaintForge ensures that appropriate technical and organizational policies have been implemented to apply the security measures established by the GDPR, with the aim of protecting the rights and freedoms of users. In addition, Users have been provided with the appropriate information to exercise these rights.

 

4. Use of the Portal and Services for Users

Unless they have the prior and expressly granted authorization from PaintForge, participants will refrain from acquiring or attempting to acquire any type of content, whether in the form of texts, graphics, resources, sound files, images or photographs, videos, software, or in general, any kind of material accessible through the Portal or the services provided by them, using means other than those provided for this purpose or those commonly used on the Internet for this purpose.

Reproduction, modification, copying, use, distribution, marketing, public communication, or any other use of the information contained on the PaintForge website (including its design, configuration, and form of display or presentation of the website) that is carried out without the authorization of PaintForge constitutes a violation of current intellectual property legislation.

To facilitate access, PaintForge may include links to Internet pages that belong to or are managed by third parties. By entering these sites, you will review and accept the usage rules of that page before using it. Likewise, you will acknowledge that PaintForge has no control over the content hosted on those servers and cannot assume any responsibility for any material created or published by them. Through this website, no personal user data is collected without their knowledge, nor is it transferred to third parties.

In order to provide the best service and enhance your experience, aspects such as the number of pages visited, the quantity of visits, visitor activity, and frequency of use are analyzed. For these purposes, PaintForge uses statistical information provided by the Internet Service Provider and Google.

It is important to note that PaintForge does not use cookies to obtain information from users. Only its own, session, and technical cookies are used, which allow the user to navigate the website and use the various options and services available on it.

 

7. Disclaimer of Content

The company assumes no responsibility, either directly or indirectly, for any content, information, communication, opinion, or manifestation of any kind that comes from the user, any person, or entity and is communicated, disseminated, transmitted, or exhibited through this portal.

 

8. Intellectual and Industrial Property

All content, as well as the names, logos, trademarks, and databases accessible from the portal’s web pages, are protected by industrial and intellectual property rights of PaintForge or third parties holding such rights. Access to the portal’s web pages does not imply, in any case, a waiver, transmission, or total or partial assignment of these rights. It also does not confer any right to use, alter, exploit, reproduce, distribute, or publicly communicate the contents or industrial property without the prior and express specific authorization from the company or the third-party holder of the rights. The rights to view and make copies for the user’s personal and exclusive use, which must always be exercised in accordance with the principles of good faith and applicable law, are excepted.

PaintForge and other product names, services, graphics, and logos are trademarks protected by PaintForge. The names of other products, services, and companies mentioned in this document may be trademarks of their respective owners.

 

9. Cancellation Policy

In the event of project cancellation by the client, the following conditions will apply:

  • The provider will retain a percentage of the total amount equivalent to the work performed up to the cancellation date.
  • This percentage will be calculated based on the breakdown of the payments indicated after budgeting each project.

For example, if cancellation occurs after the initial payment of 30%, this percentage will be retained based on the work and resources invested up to that point.

It is important to note that any material or design completed up to the cancellation date will become the property of the client once the corresponding payment has been made.

PaintForge reserves the right to unilaterally cancel the service without prior notice if any of the following conditions are met:

  • The user or external companies negatively interfere with or hinder its performance.
  • Fraudulent intentions are detected against other companies, designers, or trademarks.
  • Significant changes occur in the project compared to the agreed budget.
  • An issued invoice is not paid within a maximum period of 30 days.
  • No response is received from the client within a maximum period of 3 months.

The post-processing service for mechanical or artistic 3D parts will only be available for those projects printed by PaintForge. When a client sends us a piece printed by them, or by a service external to us, PaintForge is not responsible for unaesthetic results, defects or flaws resulting from poor printing, choice of materials or use of technologies that are not suitable for the purpose of the model, which can manifest itself as the visualization of printing lines, seams or holes derived from FDM or SLA technologies, directly affecting the overall finish of the item.

Prior to cancellation, the client will be informed of the status of their project, and the project will be deleted, auctioned, or resources related to unpaid work will be released. If it is a design, the client will receive the modeled or designed work via email in its state at the time of early cancellation.

 

10. Newsletter Subscription

All content, including texts, images, graphics, logos, and any other material present in newsletters, is protected by intellectual and industrial property rights of our company or third parties holding such rights. Subscription to the newsletter in no case implies a waiver, transmission, or total or partial assignment of these rights. It also does not confer any right to use, alter, exploit, reproduce, distribute, or publicly communicate the contents without the prior and express specific authorization granted by our company or the third-party holder of the rights.

The subscriber acknowledges that the information provided through the newsletter is exclusively for personal use and should not be used for commercial purposes without the corresponding authorization. Likewise, the reproduction, modification, copying, distribution, or any other unauthorized use of the contents in newsletters is prohibited.

The names, trademarks, and logos used in the newsletter are the property of our company and are protected by trademark rights. Any reference to products, services, and companies of third parties does not imply approval by our company, and they may be registered trademarks of their respective owners.

Newsletter subscription is personal and non-transferable. PaintForge reserves the right to modify or cancel the newsletter at any time, as well as to restrict or end the subscription of any user who violates these conditions. Any user has the right to cancel their subscription at any time through the associated form or by contacting us.

 

11. Applicable Law

In case of dispute or conflict in the interpretation of the terms that make up this legal notice, as well as any issue related to the services of this portal, the applicable law will be Spanish law. Any dispute arising from or related to this legal notice may be resolved before the competent courts in accordance with Spanish law.
